Justice Khosa indicates a departure from Saqib Nisar’s traditions

ISLAMABAD: The incoming chief justice of Pakistan Justice Asif Saeed Khosa on Thursday indicated that the apex court will take a departure from the traditions of the outgoing Chief Justice Saqib Nisar.

Addressing a full-court reference in the honour of Justice Saqib Nisar, Justice Khosa said that he will work hard to ensure the quick dispensation of justice.

He said that he would exercise suo motu jurisdiction of the apex court rarely.

Referring to Justice Nisar’s efforts to raise donations to build the Diamer-Bhasha dam, Justice Khosa said that he was also eager to build a dam, but he will build a dam against fake cases, against pending cases.

The chief justice-designate, who will take oath tomorrow, said that currently there were 1.9 million cases were pending in courts. He added that three thousand judges were too short to adjudicate such a large number of cases.

Justice Khosa said that he wanted to build a dam against false witnesses as well, saying that suo motu notices will be used sparingly

“I also want to pay off the country’s loans — I will pay off the loans of cases that have been pending for years,” he pledged.

The top adjudicator said that the trial of a civilian in a military court was considered wrong across the world. He added that there is a perception that military courts take less time to adjudicate cases, so the civilian courts should try to resolve cases in a short period of time.

He added that there was a need that high courts must exercise powers within their jurisdiction.

“When has the judiciary interfered in the matters of other institutions?” Justice Khosa asked. “Army and intelligence agencies should not interfere in civilian matters.”

“The job of the parliament is to legislate, not provide development funds. Transfers and postings are not among the parliament’s duties either.”
