Salient features of ICJ’s ruling on Kulbhushan Jadhav case

HAGUE: The international court of Justice in Netherlands has upheld the death sentence of Indian spy Kulbhushan Jhadev on Thursday.

While delivering the verdict ICJ Judge Ronny said that Pakistan should have given consular access to India as per Viana Convention.

He further stated that the matter in which state denied to allow consular access may fall under the Viana Convention.

During the case Judge Abraham said that India had requested to Pakistan for the consular access, Pakistan had sought India’s assistance in the investigation, the ICJ Judge told.

An emergency meeting of ICJ holds after the India lodge its case; it requested the court to hold the death penalty of Jhadav given by Pakistani Court.

The Indian spy was arrested last month and was convicted of organizing terrorism in Balochistan and Karachi, Pakistan military court awarded him death penalty after his confession before the court.

Here are some key points of the judgment.

1. International Court of Justice stays Kulbhushan Jadhav’s death sentence and states that he will not be executed before the court has given its final decision.

2. Pakistan should take all measures at its disposal to ensure that Kulbhushan Jadhav is not executed till the disposal of this hearing and will inform the court about measures being taken.

3. Pakistan had sought India’s assistance in the investigation of the case.

4. Kulbhushan Jadhav should have been given consular assistance under Vienna Convention.

5. All parties under Vienna Convention have rights to provide consular assistance to their nationals.

6. Rights invoked by India under the Vienna Convention are plausible.
