LHC withdrawn its application against 18th amendment

LAHORE: The Lahore High Court bar has withdrawn the application filed against 18th amendment.

Justice Saqib Nisar inquired the reason of Prime Minister not acting as the appointing authority of judges while appointing high officers including attorney general in the parallel fashion.

A seventeen member full bench carried out the hearing of applications filed against 18th and 21st amendment, which was headed by the Chief Justice Nasir-ul-Mulk.

Lahore High Court bar requested the withdrawal of application filed against 18th amendment, which was accepted.

A lawyer of District bar Saanghar Mr. Hamid Khan while advocating in the favor of the dissolution of the parliamentary committee for the appointment of judges, said that the legitimate authorities of judiciary cannot be snatched. The whole judiciary was reduced to half under PCO within 30 days.

Justice Saqib Nisar gave remarks that there would be a tussle initiated if the Parliamentary Committee is made a part of the Judicial Commission.

He said, “Would it not be suitable to give authority to judicial commission, of inquiring reports from the institutions, related to the appointment of judges?” He said that further argumentation is needed on the subject of not making executive a part of the Judicial Commission and on the Prime Minister as an appointing authority of attorney general but not that of judges.

Justice Jawad S. Khwaja gave remarks that Parliament made many amendments in the constitution. It should be reviewed that whether the supremacy of the amendment dominates or that of the old one. The hearing of this case was adjourned till Monday.
