Islamabad: The Islamabad High Court (IHC) dismissed an intra-court appeal on Thursday filed against the extension of Pakistan Chief of Army Staff General Ashfaq Pervez Kayani.
The application, filed by Ex-Servicemen’s Society legal adviser Col (retd) Inamur Rahim, was taken up by an IHC division bench comprising Justice Mohammad Anwar Khan Kasi and Justice Shaukat Aziz Siddiqui.
Advocate Rahim filed an intra-court appeal when Chief Justice Iqbal Hameedur Rehman dismissed Rahim’s petition on September 24, two days after the filing.
Justice Rehman dismissed the petition under the Section 3 of Article 199 of the Constitution, which says that the high courts could not hear cases related to the service of armed forces personnel.
The petitioner had argued in the application that General Kayani had become 60 years old on April 20, and no one could serve the military beyond that age.
